What happened in Douglas v. Visser? A broker-seller (Visser) sold a home where significant wood rot had been superficially concealed with trim and caulk. After closing, the buyers (the Douglases) found widespread structural damage and sued for fraudulent concealment, negligent misrepresentation, breach of duties, and more. Shockingly, the Court of Appeals reversed the trial court, determining that the buyers had been put on notice by their inspection and failed to investigate further—meaning they could not establish justifiable reliance.
